Fault in a used car: making a complaint

A used car can turn out to be faulty soon after the purchase. When you buy from a car dealer as a consumer, you have strong protection; in a private sale the protection is narrower. This guide explains how to establish the fault, complain correctly and where you can take the dispute.

You will need

Steps

  1. Find out the type of sale

If you bought from a car dealer, the Consumer Protection Act applies. In a sale between private individuals, the Sale of Goods Act applies, and an "as is" clause limits liability but does not release the seller from responsibility for a concealed defect.

  2. Document the fault

  3. Compare against the information and the car's age

  4. Complain promptly and in writing

  5. Make a clear claim

  6. Give the seller a chance

  7. Contact the Consumer Advisory Services

  8. Disputes in private sales
